    Thumbs down Evolution Gaming starts own Casino or Affiliation.

    Hello,

    I am Webmaster of www.evolution.casino

    I would like to inform all affiliates that Evolution Gaming started case by Wipo to claim this domain of my website from me.

    They use excuse that I used their Logo inside of my Website. ( I use their logo in homepage where is infos about Evolution Gaming.) Because of this reason, they wants to have this domain, which I have for 5 years.
    I was very positive with them, I respected them, I removed their logo. I asked if I can change anything else for them. But what they want only to have my domain.
    They blame me that I use their name for affiliation. and use their logo. This was very weird. Because in my website, I wrote positive contents about Evolution Gaming and I make nice reviews for their games. and I make affiliate for online casinos which has Evolution Gaming Live Casino Games.
    So I understood real reason after.
    After I make a bit reseach, I got it. 1 day before they send me email: they bought other domains like evolutiongaming.casino
    It means: Evolution Gaming LTD eigher start their own online casino or they will make affiliate like Netent.
    It is really funny, that Evolution Gaming try to earn money with affiliation. If they are so greedy for money, how can we trust this game provider ?

    I hope to win by Wipo. and I won't sale my domain.

    As Affiliate we promoted Online Casinos. Online Casinos and Game Providers earned a lot of money. Now Game providers wants to be affiliate. As affiliate my dream is to have own game provider brand. Netent and Evolution Gaming's dreams are to be affiliate. They are funny...

    Evolution Gaming incorporated on 25 September 2006, so you might have to give it up as you registered it in 2015. Especially as you operate in the same space, more or less.

    They should do something better with Evolution.com

    I have this domain and website since 2015. .casino domain extension excist since 2015.

    So first days of .casino I bought many domains.

    I didn't use their logo as my logo. I didn't cheat or confuse visitors. I made affiliate for casinos. I made their advertising. There is also netentcasino_com as affiliate website of catena media.

    It is not fair. What they do. But as I understand. They are so greedy. They wants to make more money even with affiliate. and They dont want to spend money. even they didnt buy this domain evolutioncasino_com but they wants to have my domain www.evolution.casino

    I have hope to win this case. otherwise I will mage Bad SEO for this domain before I lose it them.

    It is really unfortunate to hear stories like this. Companies have no interest in domains until they see there is something similar. I understand their side too.

    Unless Evolution Gaming hold a registered Trademark on this brand Name, in a jurisdiction where, that brand's registered TM is valid in direct connection with evolution.casino, then I don't think they've got a leg to stand on.

    Sounds to me like they're trying to bully you.

    I certainly wouldn't hand over the domain without a court order, that's for sure.

    You are just guessing that they want to start affiliate sites.

    In my opinion someone within Evolution has started to protect their trademark and is going around collecting domains using thier brand name. It's probably as something as simple as that.

    Other providers have done exactly the same. And now with the worlds eyes on Evolution, due to the purchases they have been making and their entry into the US in a big way, they seem to be tidying things up.

    It's unfortunate for you, but you did use you their name for your gain in your domain name and you're promoting them on your site, so it does look like it looks I'm afraid.

    You may have had a better chance of keeping it if you were using it for something non gambling related.

    There are other affiliate sites using brand names and i know for certain that when some of them did that they approached the brand to make sure it was OK before doing so, thus avoiding the situation you're now finding yourself in.

    I hope it works out for you. You might start considering what your plan B should be, so you can keep your business running.

    I took a closer look at their logo and their Brand Name does indeed hold the R (registered) Trademark Symbol. If that Trademark is held in the country which owns the TLD for dot "casino" or that country acknowledges outside TM's, then unfortunately I'd say the OP is screwed.

    See that their trademark is Evolution Gaming from what i see. Not Evolution.

    I don't see them trademark the word evolution. I don't see how it can hold a case against you in any way.

    I would however see that your site focus is not on evolution gaming only and such as if they prove you ride their name its a different story.

    I really guess it after many emails and discussion with them. I offer them many things and they are not interested. And they are against it that I do affiliate.

    I check by whois. 1 day before they send me email they bought this domain evolutiongaming.casino

    I think they will make affiliate like NEtent ( anyways they buy netent ) or maybe they will make their own online casino.

    Let me tell you something. They can only trademark Evolution+Gaming .... they cannot trademark Evolution alone, its impossible. Just get rid of their logos and thats it!

    Since you bought it at least they should buy it for some decent money from you... even 1-5k will do (i hope they offer it) ... at least you can move your things on a different domain name and move on.

    PS: I would remove Evolution Gaming keyword from the site. Maybe try Evolution Casino(s) , Evolution Casino sites etc... but as as a reference thing... This way it's very hard for them to take it. But even so i doubt they have a case.

    I hate big brands going for a general keyword (greedy bastards) ... FK em, they have no right... they should offer u a decent price ! they have money btw!!!

    It is actually quite good it is a general keyword. No Trademark case can be issued for words like Evolution, Faster, Sun, Moon etc. . Their case against evolution.casino I can only assume of course, is that the site is quite clearly using Evolution Gaming as keyword and that they do have a case against as it could be argued it affects their business. If I were you @tumcasino just clean your site up to be more generic and their case weakens. If it comes to a sale, don't let it go cheap. They wouldn't be bothering you unless it has some value for them at least.

    i tried to trademark a word with slot inside .. and IGT has put an opposition because the have the trademark on The Slot .. my word had a different meaning but this euipo fkers gave them right ....

    One question connected to this topic: What happens if you have a generic domain name like "bet.(something)" or "onlinebetting.something" or football.something, is there any risk that someone can claim your domain, or this kind of generic word is excluded?

    As witnessed above, there is some debate surrounding it, but it may depend on whether the "something" is a registered trademark or brand name.

    Each individual case can be different, and each individual "brand" might react differently.

    The talk of trademarks is a red herring and basically irrelevant because the law doesn't stand and fall on that point. Did you register this domain because Evolution Gaming exists? If you did, it was done in bad faith. It seems to me you would never have registered it otherwise. You can't just go round stealing company trade names and then complaining when the company you are passing off as catches up with you. You have become just an irritation to them - you registered an 'evolution' name related to their market long after they had made a name for themselves. If you had done it BEFORE, then you would be completely in the clear. I don't think you have a leg to stand on legally or ethically. Amazed you have got so much support in this thread - how would all your supporters like it if you registered and built affiliate sites on websites using their domain names. They'd be singing a different song then. In business you will make more money acting ethically.
